A recent survey by independent charity Arts & Business Scotland and accountancy firm Scott-Moncrieff indicates that over 75% of Scottish museums and galleries have not been claiming the Museum & Gallery Exhibitions Tax Relief introduced in 2017 to encourage museums and galleries to develop new exhibitions and display their collections to a wider audience.

Museum & Gallery Exhibitions tax relief  provides relief for qualifying expenditure on exhibitions incurred by companies running museums and galleries and took effect from 1 April 2017:

  • The company must be either:
    • A charitable company
    • A wholly owned subsidiary company of a charity or
    • A wholly owned subsidiary company of a local authority,
  • Relief is by way of enhanced deduction or payable credits. Companies claim a deduction for 100% of the lower of:
    • EEA qualifying expenditure, or
    • 80% of qualifying expenditure.
  • Touring exhibitions can claim up to £100,000 per exhibition, and non-touring exhibitions up to £80,000.
  • If the company makes a loss it can surrender the lower of the loss and the qualifying expenditure and be paid a 25% tax credit.

Many museums and galleries, whether in Scotland or elsewhere, are charities who do not pay corporation tax meaning reliefs such as this may get overlooked. The relief can also apply to libraries, historic homes and outdoor exhibition sites such as sculpture parks.
