As part of its ‘ Making Work Pay’ commitment, the Government has opened a consultation on creating a modern framework for industrial relations.
With plans to repeal the Trade Union Act 2016 and the Strikes (Minimum Service Levels) Act 2023, on the basis that the legislation does not work, this consultation considers a wide range of options for reforming industrial relations.
The consultation seeks views on:
- Simplifying the amount of information unions must provide in industrial action notices.
- Strengthening provisions to prevent unfair practices during the trade union recognition process.
- Removing the 10-year ballot requirement on political funds.
- Securing a mandate for negotiation and dispute resolution.
- Extending the expiry of the strike mandate.
- Reducing the industrial action notice period.
- Updating the law on repudiation and prior call.
- The enforcement mechanism for the right of access.
This consultation is aimed at those with technical knowledge of trade union legislation and practices and key stakeholders. It provides an opportunity for all interested parties to contribute to the policy development as set out.
