Trustees should be aware that the deadline for registering trusts with a UK tax liability for the first time in 2017/18 is 5 October 2018.

Under the Trust Registration service all trusts with UK tax liabilities must be registered with HMRC under an online registration system. For trusts set up in 2016/17, it being the first year of the online system, trustees had until 5 January 2018 to register, however this was part of a ‘soft landing’ for the new system. The deadline is now 5 October following the relevant tax year, with amendments to the register being due by the following 31 January, though these cannot yet be completed online.

Late registration penalties can apply; these were also subject to a soft landing for the first year but this period has now passed.
