MTD: late payment penalties further consultation
HMRC has published a further consultation on interest and penalties, 'Making Tax Digital: interest harmonisation and sanctions for late payment', proposing new rules for how late payment interest and penalties will operate.

MTD: sanctions for late submission and payment - consultation response
HMRC have published a response to their consultation “Making Tax Digital – sanctions for late submission and late payment”, which includes details of the new points-based penalty system for late returns.

MTD: Consultation on Draft legislation: The Value Added Tax (Amendment) Regulations 2018
HMRC has published draft secondary legislation in respect of Making Tax Digital (MTD) for VAT in the form of regulations, a draft explanatory memorandum and draft VAT Notice, for public comment.

HMRC has now published its response following the consultation on the advance assurance service for tax-advantaged venture capital schemes that ran from 5 December 2016 to 1 February 2017.

HMRC ran a consultation from 11 November 2016 to 3 February 2017 on Simplifying the Gift Aid donor benefits rules and has now published its summary of responses.

Taxing gains made by non-residents on UK immovable property
Following Autumn Budget 2017 HMRC have published a consultation on the proposals to extend CGT to commercial property and bring non-close companies into the NRCGT regime.

Non-resident landlords

Taxing non-resident landlord companies: consultation response
HMRC has published a response to its consultation ‘Non-resident companies chargeable to Income Tax and non-resident CGT’. It concludes that these companies should move into corporation tax.

Taxation of Employee Expenses

Taxation of employee expenses: Response to call for evidence
On 1 December 2017, HMRC published the response to its “Taxation of employee expenses call for evidence”, which closed on 10 July 2017. Changes were introduced in the budget on the use of HMRC’s scale rates and HMRC is to look further into training costs and improving its guidance.

Offshore Notifications

Notifying HMRC of Offshore Structures: Consultation Response
On 1 December 2017, HMRC published a summary of responses to their consultation “Tackling offshore tax evasion: A requirement to notify HMRC of offshore structures", which closed on 27 February 2017. Instead of taking this forward, the Government will work with the OECD and EU to produce multinational rules along the same lines.

Royalties Withholding Tax - consultation
On 1 December 2017, HMRC published Royalties Withholding Tax - consultation. It proposes extending the rules imposing withholding tax (WHT) on royalty payments made to non-UK residents.

HMRC have issued a consultation document, 'VAT and Vouchers', which is the first step in the transposition of the EU Vouchers Directive 2016/1065, into UK VAT law.
